A tuplet bracket/number must clear the beam it runs parallel to, or be omitted when the beam alone is unambiguous

A tuplet bracket is drawn only when the group is NOT already beamed together; when a bracket IS drawn (unbeamed tuplet), it must clear the noteheads/stems it spans.

A beamed eighth-note triplet renders BOTH a bracket directly overlapping the beam AND the '3', when standard practice shows just the '3' with no bracket.
